Public Procurement Law

Our lawyers have been active in the area of public procurement law since 1998. Our lawyers serve as counsel for both public contracting authorities and contracting entities operating in the water, energy, transport and telecommunications sectors as well as for tenderers, and offer a full range of advice on issues relating to public procurement law. Our services range from providing assistance with the invitation to tender and preparation of the necessary tender documents and drafting recommended decisions for contracting authorities, as well as implementing procurement procedures as trustees. Therefore, since the act modifying public procurement law (Vergaberechtsänderungsgesetz) entered into force on 1 January 1999, tenderers have had individual rights to the contracting authorities compliance with award procedures, and can enforce these rights in a judicial review procedure. We also offer conflict prevention and management on the part of both tenderers and contracting authorities - in the form of a judicial review procedure if necessary. Our lawyers have acquired particular expertise in the domain of electronic procurement, and provide legal assistance with the development of corresponding procurement solutions in particular.
